IS NJC IGNORANT OF OUR LAWS
Prof. Chidi Odinkalu has reportedly Petitioned Mr. President contesting the propriety of 33 man List submitted by NJC for presidential approval/appointment as Judges of FCT High Court. The List which had earlier generated controversies on other grounds, such as whether it reflected the Federal Character Principles, seems to be on collision course with the express letters of Section 1 of High Court of FCT (Number of Judges) Act, 2003 which provides:
“The High Court of the Federal Capital Territory, Abuja, shall consist of-
(a) a Chief Judge ofthe High Court of the Federal Capital Territory, Abuja; and
(b) a maximum number of thirty-seven Judges of the Court.”
Presently, FCT High Court has 34 jurist and can only accommodate additional 4 members, in view of the extant law aforementioned. This apparent oversight from a body of eminent jurists and senior members of the Bar (NJC) is indeed very embarrassing.
Personally, I think that it is high time the High Court of FCT (Number of Judges) Act, 2003 is amended. We need more judges in FCT. I therefore suggest that NBA National/Unity Branch should immediately take steps to propose amendment of Section 1 of High Court of FCT (Number of Judges) Act, 2003.
